Terms of Service

The terms that govern your use of The Storemate.

The Storemate is a software-as-a-service e-commerce platform operated by Adhirohaah Industries, a sole proprietorship of Yashh Mittal (GSTIN 07BDZPM9464M1ZA), based in Delhi, Delhi – 110032, India ( “The Storemate”, “we”, “us”). This Terms of Service is an electronic record under the Information Technology Act, 2000 and does not require any physical or digital signature. Full postal address available on request. Questions? 1Acceptance of these terms

By creating an account or using The Storemate, you agree to these Terms of Service and to our Privacy Policy and Cookie Policy, which are incorporated by reference. These Terms are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. If you do not agree, do not use the service.

You confirm that you are at least 18 years old and competent to enter into a binding contract under the Indian Contract Act, 1872, and that you are using the service for a lawful business purpose.

2The service we provide

The Storemate is a hosted platform that lets you build, customise and operate online storefronts, manage products, orders and customers, and accept payments through third-party payment providers. We provide and maintain the software.

You are solely responsible for the products, content, pricing, offers, descriptions and lawfulness of any store you run using The Storemate.

3Your account

You are responsible for all activity under your account and for keeping your credentials secure. You must provide accurate, current information and a valid email address, and promptly notify us of any unauthorised use of your account.

4Acceptable use

You agree not to misuse the service, attempt to disrupt or gain unauthorised access to it, reverse-engineer it, or use it to violate any applicable law or the rights of others. You must comply with all laws that apply to your business, including the Consumer Protection Act, 2019, the Legal Metrology Act, 2009 and applicable GST law.

You must not host, display, upload, publish or share any information that is prohibited under Rule 3(1)(b) of the IT Rules, 2021 — including content that is unlawful, defamatory, obscene, infringes intellectual property, harms minors, or is otherwise objectionable. We may remove such content and suspend accounts that breach this clause.

5You are the seller to your customers

You are the seller of record for every sale made through your store. You are responsible for your own store policies, product listings, pricing, taxes, order fulfilment, shipping, and any returns or refunds owed to your customers. The Storemate acts only as an intermediary providing the platform and is not a party to any transaction between you and your customers.

6Plans, billing and taxes

Paid plans are billed in Indian Rupees per the pricing shown at sign-up, through our third-party payment processor. Applicable Goods and Services Tax (GST) is charged in addition to, or as indicated in, the listed price (GSTIN 07BDZPM9464M1ZA). You are responsible for any taxes arising from your own sales to your customers.

7Cancellation and refunds

You may cancel your plan at any time from your account settings; cancellation stops future billing and your access continues until the end of the current paid period. Fees already paid are non-refundable, except where a refund is required under applicable law. This policy is provided in accordance with the Consumer Protection (E-Commerce) Rules, 2020.

8Intellectual property

We own all rights in the Storemate platform, software, and brand. You retain ownership of the content, products and data you add to your store, and you grant us a limited licence to host, store, process and display that content solely to operate and provide the service to you.

9Suspension and termination

You may stop using the service at any time. We may suspend or terminate access for breach of these terms or applicable law. On termination you may export your data for up to 30 days, after which it is deleted or anonymised in line with our Privacy Policy, subject to records we are required by law to retain.

10Disclaimers and limitation of liability

The service is provided on an “as is” and “as available” basis. We do not warrant that it will be uninterrupted or error-free.

To the maximum extent permitted by law, The Storemate is not liable for any indirect, incidental or consequential damages, and our total aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the three months immediately preceding the event giving rise to the claim.

11Indemnity

You agree to indemnify and hold harmless The Storemate against any claim, loss or liability arising from your store, your content, your sales to customers, or your breach of these terms or of any applicable law.

12Governing law and jurisdiction

These terms are governed by the laws of India. Any dispute will first be attempted to be resolved amicably, and failing that, the courts at Delhi shall have exclusive jurisdiction.

13Changes to these terms

We may update these terms from time to time; material changes will be communicated to you. Your continued use of the service after changes take effect means you accept the revised terms.

14Grievance Officer

In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Digital Personal Data Protection Act, 2023, the details of our Grievance Officer are set out below. You may contact the Grievance Officer for any complaint or query regarding the service or your personal data.
